TERMS AND CONDITIONS OF SALES

A. These Terms and Conditions, dated June 30, 2006, are for the sale of products not fabricated or

manufactured by Booster Pump Technologies and are typically sold and invoiced via the Internet.

B. Point and Title, Liability: All items are sold F.O.B. Factory, domestic. Title to all items sold shall pass

to Buyer upon delivery by Seller to Carrier at shipping point.

C. Prices and specifications are subject to change without notice.

D. Shipping dates are approximate, subject to delays beyond our control.

E. TERMS: Full payment is to be made prior to shipment. Net 30 days to companies with established

accounts and/or credit rating.

1) Where credit is granted and payment is not made per terms and or within 30 days, a 2% per

month or portion thereof late charge will be assessed. In addition to a late charge a processing fee of

$25.00 or 5%, whichever is greater, shall be assessed as well.

F. Taxes: All taxes that may apply to the sale, purchase, delivery, use or consumption of any items

covered hereby shall be the sole responsibility of and paid by the Buyer. California sales tax, if

applicable, shall be added to the purchase price and shall be for the account of the Buyer.

G. Limited Warranty: The Seller warrants items sold and covered hereunder to the extent of the

manufacturers warranties only. Typically items are warranted to be free from defects in workmanship or

material under normal use and service when installed and used per standard industry practices and or

instructions. Typically these warranties are for a period of one year from date of shipment. Liability under this

warranty is limited to repair or replacement F.O.B. Factory and or repayment of purchase price, at Sellers

option, of any items which prove to be defective within that time period provided the items have been

returned, freight prepaid. Instructions and or advice from Seller to Buyer and or from manufacturer to Buyer

written or verbal is data believed to be accurate and reliable and are intended for use by persons having skill

and knowledge of the items' use and or the business. In no case shall the Seller be liable beyond aforesaid

limited warranty.

THIS EXPRESS LIMMITED WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER REPRESENTATIONS AND

WARRANTIES, BOTH EXPRESS AND IMPLIED. THERE ARE NO IMPLIED WARRANTIES OF MERCHANTABILITY

OR FITNESS FOR A PARTICULAR PURPOSE FOR ITEMS COVERED HEREUNDER.

H. Acceptance of a quotation by signature or via telecommunication acknowledgement constitutes a contract

order. Acceptance of and or payment of an invoice constitutes a contract order. All orders are subject to

the Sellers terms and conditions contained herein and contained elsewhere and contained in our catalog

and to no others whatsoever. No alterations of these terms and conditions are binding, allowed or agreed to

unless in writing and signed by an executive of Booster Pump Technologies ( Seller ).

I. Export Orders: We do not export.

J. All sales are per Booster Pump Technologies Terms and Conditions only. No other terms and conditions

are agreed to.
